Terms of Service

Effective October 26, 2026 · Last updated October 26, 2026

These terms cover the Evermont web application and the Evermont connector and plugin you use from Claude, ChatGPT, Codex and other AI clients. Our Privacy Policy explains how we handle data.

1. Agreement

These Terms of Service (the “Terms”) govern your access to and use of Evermont, provided by Evermont Inc. (“Evermont”, “we”, “us”). Evermont includes the evermont.ai website and web application, the Evermont MCP server at https://api.evermont.ai/mcp, the Evermont connector and plugin for third-party AI clients, downloadable packages and skills, and related APIs and support (together, the “Service”).

By creating an account, connecting Evermont to an AI client, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organization, you confirm that you have authority to bind it, and “you” and “Customer” refer to that organization. If you do not agree, do not use the Service.

If you have signed an order form or other written agreement with us for the Service, that agreement controls where it conflicts with these Terms.

2. The Service

Evermont helps insurance filing, actuarial and compliance teams research SERFF rate and form filings, understand state filing requirements, and prepare and manage their own filings. You can use it in the Evermont web application or from an AI client you connect to the Evermont MCP server, such as Claude, ChatGPT or Codex.

We change and improve the Service over time, and we may add, modify or remove features. Features we label as preview, beta or early access are provided for evaluation, may change without notice, and may be less reliable than the rest of the Service.

3. Accounts and organizations

  • The Service is for business use. You must be at least 18 and provide accurate account information.
  • Each account belongs to an organization. The organization owner manages roles; owners and administrators invite and remove members and manage API keys. What a member can reach is limited to the organizations they belong to.
  • API keys belong to your organization, not to the person who created them, and keep working until an owner or administrator revokes them.
  • Keep your sign-in credentials and API keys confidential. You are responsible for activity under your account and under any connection or API key created for your organization.
  • Tell us promptly at hi@evermont.ai if you believe your account, a connection or an API key has been compromised.

4. Connected AI clients and third-party platforms

Claude, ChatGPT, Codex and other AI clients are third-party products. Your use of them is governed by your agreements with their providers (for example Anthropic or OpenAI), and those providers process the prompts, files and tool results in your conversations under their own terms and privacy policies. We do not control those products and are not responsible for them.

When you connect a client to Evermont, by signing in and approving access or by configuring an API key, you authorize Evermont to respond to requests that client makes on your behalf, within the organization you chose when you approved the connection. A connection made with an API key can use every Evermont tool available to your organization, and a signed-in connection can use those that the access you approved covers. That can include tools that create or change records, such as filings, documents, requirement answers and objection responses; no tool deletes filings or documents. You are responsible for the actions your AI client takes through Evermont, so review what it proposes before approving changes.

You can disconnect a signed-in client from the client’s own settings at any time, or ask us at hi@evermont.ai to revoke a connection on our side. An organization owner or administrator can revoke an API key at any time in the web application.

5. Your data

“Customer Data” means the content you or your AI clients submit to the Service, such as filings, uploaded documents, answers, drafts and other materials you create in your organization. As between you and us, you own your Customer Data.

You grant us a limited right to host, copy, process, transmit and display Customer Data only as needed to provide, secure, support and improve the operation of the Service for you, and as described in our Privacy Policy. This includes sharing it with the service providers listed there, such as the AI providers that index documents and run drafting tools. We do not currently use Customer Data to train AI models, and we do not sell it.

We will use reasonable administrative, technical and physical safeguards to protect Customer Data, and we will access it only as described in the Privacy Policy. We may use information about how the Service is used, such as tool usage counts, error rates and response times, to operate, secure and improve the Service. We will not disclose it to others in a form that identifies you or reveals your Customer Data.

You are responsible for having the rights, notices and consents needed to submit Customer Data, and for its accuracy. Please do not submit personal information about policyholders or other individuals unless it is needed for your filing work, and do not submit the restricted data described in section 8.

6. Public regulatory data

The Service includes information compiled from public regulatory sources, including SERFF filings made public by state insurance departments and state statutes, regulations and guidance. This information is provided for research. It may be incomplete, out of date, or contain extraction errors, and coverage varies by state, line of business and year. Always confirm important details against the official source before relying on them.

Public filings can name the people who prepared or reviewed them. Use that information only for regulatory research and your filing work, and in line with applicable law.

7. AI-generated output

The Service uses AI models and automated tools to produce search results, summaries, checklists, calculations, drafts and other output (“Output”). Output can be inaccurate or incomplete, even when it includes citations.

  • Output is not legal, actuarial, regulatory or other professional advice, and it does not create a professional relationship with Evermont.
  • Qualified people at your organization must review and verify Output before you rely on it or submit anything to a regulator.
  • You are responsible for your filings, including their accuracy, completeness and compliance with applicable law. We do not guarantee that a regulator will accept or approve any filing.

Subject to these Terms, you may use Output you receive for your internal business purposes.

8. Acceptable use

You agree not to, and not to let anyone else:

  • use the Service in violation of law or the rights of others;
  • share credentials or API keys outside your organization, or access another organization’s data;
  • probe, bypass or interfere with the Service’s security, authentication, access controls or usage limits;
  • reverse engineer the Service, or extract our prompts, methods or compiled datasets except as the Service is designed to return them;
  • scrape the Service, bulk-download from it beyond its built-in download features, or use it to build a competing product or dataset;
  • submit restricted data, unless we have agreed to it in writing: health information about identifiable individuals (such as protected health information), payment card data, government identification numbers (such as Social Security, driver’s license or passport numbers), or passwords and other credentials;
  • upload malware or content you do not have the right to share; or
  • overload the Service or run load or penetration tests without our written permission.

9. Fees and usage

Fees, usage allowances and payment terms are those in your order form or quote, or shown to you when you buy. Tool calls and document indexing are measured in Evermont credits against your organization’s monthly allowance. We may limit usage beyond your allowance. Fees are exclusive of taxes, which you are responsible for. We may suspend paid features if fees are overdue after notice. Trials and free access may be limited, changed or ended at any time.

10. Intellectual property

We and our licensors own the Service, including its software, tools, server-side methods and prompts, compiled datasets, documentation and branding. These Terms do not grant you any rights in the Service other than the right to use it as described here. If you send us feedback or suggestions, we may use them without obligation to you.

11. Confidentiality

Each party will protect the other’s non-public information that it receives in connection with the Service with reasonable care, use it only for the purposes of these Terms, and share it only with people who need it for those purposes and are bound to protect it, and with the service providers described in our Privacy Policy, which handle it under their own terms. This does not apply to information that is public, already known to the recipient, independently developed, or that must be disclosed by law.

12. Availability and support

We work to keep the Service available and secure, but it may be interrupted for maintenance, updates or reasons outside our control. Unless your order form includes a service level commitment, we do not guarantee any particular availability. Support is available at hi@evermont.ai and through our contact page.

13. Suspension and termination

You may stop using the Service at any time. You can disconnect signed-in clients yourself or ask us to revoke them, and owners and administrators can revoke API keys. We may suspend or terminate access if you breach these Terms, if your use creates a security or legal risk, or if fees are unpaid, and we will give notice where reasonable. Before your access ends, you can download your documents through the Service. When access ends, your right to use the Service ends. You can ask us to delete your Customer Data at any time, and we will do so as described in our Privacy Policy or your order form. Sections that by their nature should survive termination, including those on fees owed, confidentiality, intellectual property, disclaimers, limitation of liability, indemnification and governing law, will survive.

14. Disclaimers

To the fullest extent permitted by law, the Service, Output and public regulatory data are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

15. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or relating to these Terms or the Service. Each party’s total liability arising out of or relating to these Terms or the Service will not exceed the fees you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred US dollars if you have paid no fees. These limits do not apply to your payment obligations or to liability that cannot be limited by law.

16. Indemnification

You will defend and indemnify Evermont against third-party claims arising from your Customer Data, from filings or other materials you submit to regulators or others, or from your use of the Service in breach of these Terms.

17. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Disputes arising out of or relating to these Terms will be resolved in the state or federal courts located in the State of Delaware, unless your order form says otherwise.

18. Changes to these Terms

We may update these Terms. When we do, we will post the new version here and update the date above. If a change is material, we will give reasonable notice before it takes effect, for example by email or in the Service. By continuing to use the Service after a change takes effect, you accept the updated Terms.

19. General

These Terms, together with any order form and our Privacy Policy, are the entire agreement between you and us about the Service. You may not assign these Terms without our consent, except to a successor of your business. If any provision is unenforceable, the rest stays in effect. A failure to enforce a provision is not a waiver. Neither party is responsible for delays caused by events beyond its reasonable control. You will comply with applicable export control and sanctions laws.

The parties are independent contractors, and these Terms create no rights for anyone else. We may send notices to the email address on your account or show them in the Service. Send notices to us at hi@evermont.ai.

20. Contact
